Transfer Mechanisms

  • Adequacy Decision — Transfer to a country recognised by the NDPC as providing adequate protection
  • Standard Contractual Clauses — Contractual safeguards approved by the NDPC
  • Binding Corporate Rules — Intra-group rules approved by the NDPC
  • Derogation — Specific exceptions (explicit consent, contract necessity, etc.)
  • Other — Any other mechanism approved by the NDPC

National Assembly Approval

The NDPA uniquely requires that certain transfer instruments be approved by the National Assembly. Track this approval status for each transfer to ensure full compliance.

NDPC Approval

The NDPC must approve certain cross-border transfers. Record whether NDPC approval has been obtained for each transfer arrangement.
